Manhattan U.S. Attorney Jay Clayton has filed a request for a retrial of Roman Storm, the co-founder of Tornado Cash, on charges that previously left a jury deadlocked. The retrial dates are proposed to fall between October 5 and 12, with an anticipated duration of three weeks. Despite the readiness of the prosecution to proceed earlier, the defense team has indicated their unavailability until late 2026.
Although a jury convicted Storm on operating an unlicensed money transmitting business last August, they could not reach a unanimous decision on charges of money laundering and violating sanctions. A hung jury does not equate to an acquittal, allowing prosecutors to pursue the case further. Storm, however, has challenged his existing conviction, arguing the government has failed to substantiate claims of him aiding in laundering money.
